Because the states have this freedom, the laws change from state-to-state. However, the federal law does control one particular jurisdiction- federally owned land, such as national parks. Drivers who drive drunk in these preserves are often punished more severely then they would be punished by state courts. Drunk driving in a national park is a Class B misdemeanor and can result in up to six months in a federal penitentiary and a fine of up to $5,000.
